Acceptance of Terms

By accessing or using Vizcogs ("the Service"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, please do not use the Service.

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes constitutes acceptance of the modified terms.

Service Description

Vizcogs is a visualization tool for vinyl record collections stored on Discogs. The Service allows you to:

  • Connect your Discogs account to view and visualize your collection
  • View marketplace statistics and estimated values for your records
  • Explore your collection through various interactive charts and visualizations
  • Participate in the Community leaderboard showcasing collection statistics

The Service is provided "as is" and relies on data from Discogs. We do not guarantee the accuracy, completeness, or timeliness of any information displayed.

Community Leaderboard

When you connect your Discogs account and load your collection, aggregated statistics (vinyl count, top genres, year range) are automatically collected and displayed on our Community leaderboard. By default, your profile appears anonymously with your username obscured. You may choose to make your profile public in Settings, which reveals your Discogs username and provides a link to your collection. You may opt out of the Community leaderboard entirely via Settings.

Advertising

Vizcogs displays advertisements to support the free operation of the Service. We use Google Ads and related Google services for advertising and analytics. By using the free tier of the Service, you acknowledge and agree that:

  • Advertisements will be displayed throughout the Service for free users
  • We use Google Ads to serve advertisements and collect analytics data
  • Google and other advertising partners may collect information about your use of the Service to provide personalized advertisements
  • You may see ads based on your browsing activity across the web

Paid subscribers (Pro tier) do not see advertisements. For more information about how advertising data is collected and used, and your choices regarding personalized advertising, please see our Privacy Policy.

Ad Blocking

While we respect your right to use ad-blocking software, we encourage free users to consider supporting the Service by allowing ads or upgrading to Pro. Revenue from advertising and subscriptions helps us maintain and improve Vizcogs.

Your Account

Discogs Integration

To use Vizcogs with your personal collection, you must authorize the Service to access your Discogs account via OAuth. By doing so, you:

  • Confirm you are the authorized owner of the Discogs account
  • Grant Vizcogs permission to access your collection and marketplace data
  • Agree to Discogs' Terms of Service

Public Collections

You may also view public Discogs collections without logging in. When viewing public collections, you agree to respect the privacy and property rights of collection owners.

Account Security

You are responsible for maintaining the security of your Discogs account credentials. Vizcogs never sees or stores your Discogs password.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms.

Permitted Use

You may use the Service to:

  • View and visualize your own Discogs collection
  • Browse public Discogs collections
  • Access marketplace statistics and estimated values for personal reference
  • Share links to visualizations of your own collection

Prohibited Conduct

You agree NOT to engage in any of the following:

Data Misuse

  • Scraping, harvesting, or systematically downloading data from the Service
  • Using automated tools (bots, crawlers, scripts) to access the Service
  • Attempting to bypass or circumvent Discogs API rate limits
  • Reselling, redistributing, or commercially exploiting data obtained through the Service
  • Using the Service to build competing products or services

Security Violations

  • Attempting to probe, scan, or test the vulnerability of the Service
  • Attempting to breach or circumvent security or authentication measures
  • Accessing data not intended for you or logging into accounts you are not authorized to access
  • Interfering with service to any user, host, or network

Abuse & Illegal Activities

  • Harassing, abusing, threatening, or intimidating others
  • Impersonating any person or entity
  • Violating any applicable laws or regulations
  • Infringing on intellectual property rights

System Abuse

  • Overloading, flooding, or overwhelming the Service
  • Introducing malware, viruses, or other harmful code
  • Attempting to modify, reverse-engineer, or decompile the Service

Enforcement

We reserve the right to investigate violations and take action including warnings, suspension, or termination of access, and reporting to law enforcement if appropriate.

Intellectual Property

Vizcogs Content

The Service, including its original content, features, and functionality, is owned by Vizcogs and is protected by copyright, trademark, and other intellectual property laws.

Third-Party Content

Album artwork, release information, and marketplace data displayed through the Service are sourced from Discogs and remain the property of their respective owners. Vizcogs does not claim ownership of this content.

Your Content

Your Discogs collection data remains your property. By using the Service, you grant us a limited license to access and display this data solely to provide the Service to you.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • Any estimated values or market data will reflect actual market conditions
  • The Service will meet your specific requirements

Value Estimates

Collection valuations displayed by the Service are estimates based on Discogs marketplace data and should not be relied upon for insurance, sale, or tax purposes. Actual market values may vary significantly. We recommend obtaining professional appraisals for significant transactions.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIZCOGS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or similar issues transmitted through the Service
  • Any errors or omissions in any content
  • Reliance on value estimates or market data provided by the Service

Indemnification

You agree to indemnify and hold harmless Vizcogs and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

You may terminate your use of the Service at any time by disconnecting your Discogs account and ceasing to use the Service.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts.
